BEING A BY-LAW TO AMEND BY-LAW No. 2009-095, A BY-LAW TO PROHIBIT THE UNNECESSARY USE OF STOPPING AND IDLING OF VEHICLES WITHIN THE TOWN OF COLLINGWOOD

AND WHEREAS section 428 of the Municipal Act, 2001, S.O. 2001,c. 25, authorizes municipalities to enact and pass by-laws where a vehicle has been left parked, stopped or standing in contravention of a by-law passed under the Act, the owner of the vehicle is guilty of an offence, even though the owner was not the driver of the vehicle at the time of the contravention of the by-law, and is liable to the applicable fine unless, at the time of the offence, the vehicle was in the possession of another person without the owner’s consent;
AND WHEREAS Council of the Town of Collingwood passed By-law No. 2009-095, being a by-law to prohibit the unnecessary use of stopping and idling of vehicles within the Town of Collingwood;
AND WHEREAS Council deems it expedient to amend By-law No. 2009-095 to alter temperature limits and regulations within the prescribed exceptions of the by-law;
NOW THEREFORE COUNCIL OF THE CORPORATION OF THE TOWN OF COLLINGWOOD ENACTS AS FOLLOWS:

THAT Section 3.2 (j) of By-law No. 2009-095 be amended as follows:
3.2 (j) during weather conditions where outside temperatures exceed 27oC or fall below 5oC, except when applied to commercial vehicles where the outside temperature falls below 0oC, and where idling may be reasonably necessary for the proper operation of air conditions or heating equipment but only so long as the vehicle is occupied by one or more persons.
- THAT this By-law shall come into full force and effect on the date of final passage hereof at which time all By-laws and/or resolutions that are inconsistent with the provisions of this By-law and the same are hereby repealed or rescinded insofar as it is necessary to give effect to the provisions of this By-law.
